1. Acceptance of Terms
By accessing or using the k4cart platform ("Service") at k4cart.com, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users including store owners ("Merchants") and end customers who purchase through Merchant storefronts.
2. Description of Service
k4cart provides a SaaS platform that allows Merchants to create and manage online stores, list products, accept payments, and fulfill orders. k4cart acts as a technology platform only and is not a party to transactions between Merchants and their customers.
3. Eligibility
You must be at least 18 years of age and capable of entering into a binding contract under applicable Indian law to use this Service. By registering, you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] of any unauthorized use of your account.
5. Merchant Responsibilities
As a Merchant, you agree to:
- Provide accurate and truthful product descriptions, prices, and images
- Fulfill orders in a timely manner and as described
- Handle customer complaints and disputes professionally
- Comply with all applicable Indian laws including the Consumer Protection Act, 2019 and IT Act, 2000
- Not sell prohibited, counterfeit, or illegal goods
- Collect and remit applicable GST as required
6. Prohibited Uses
You may not use the Service to:
- Sell illegal, counterfeit, or hazardous products
- Engage in fraudulent transactions or misrepresentation
- Violate any applicable law or regulation
- Transmit malware, spam, or unauthorized advertising
- Scrape, reverse-engineer, or attempt to access our systems without authorization
- Infringe on the intellectual property rights of others
7. Payments
Payment processing is handled by Razorpay. By using our payment features, you agree to Razorpay's Terms of Service. k4cart is not responsible for payment failures, delays, or disputes arising from the payment gateway.
8. Subscription and Billing
New Merchant accounts begin with a 14-day trial under the Launch plan limits. After the trial, continued access to paid features requires an active subscription. Current plans and prices are shown on our pricing page. Subscriptions renew automatically unless cancelled before the next billing date. Please refer to our Cancellation & Refund Policy for details on cancellations and refunds.
9. Intellectual Property
The k4cart platform, including its design, code, trademarks, and content, is the exclusive property of k4cart. You may not copy, modify, or distribute any part of the platform without our prior written consent.
You retain ownership of all content (product images, descriptions, store data) you upload to the platform. By uploading, you grant k4cart a limited licence to display and deliver that content as part of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, k4cart shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of revenue, data, or business opportunities. Our total liability to you shall not exceed the amount paid by you to k4cart in the three months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or act in a manner harmful to other users or the platform. You may close your account at any time by contacting us.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India. We encourage resolving disputes amicably; please reach out to us first at [email protected].
13. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
